These Terms & Conditions (“Terms”) govern your use of our website www.afis.org.uk (“the Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to them, please discontinue use of the Site. We only provide these Terms in the English language.

1. Who We Are

The Site is operated by the Association for Families of Independent Schooling CIC (AFIS CIC), a Community Interest Company incorporated in England & Wales (company number 16817786).

References to “AFIS”, “we”, “us” and “our” mean AFIS CIC.

These Terms apply to all users, including members accessing restricted content.

We may update these Terms from time to time. Significant changes will be noted in Section 13.

In these terms we use the term "AFIS™ site" to refer to our website at www.afis.org.uk and our mobile and online digital apps and services.

References in these terms and conditions to "AFIS™" (or "we", "us" or "our") refer to Association for Families of Independent Schooling (AFIS) C.I.C. a community interest company registered in England & Wales, Company Number 16817786, whose registered address is 12 Fratton Road, Portsmouth, PO1 5BX, United Kingdom.

2. Access and Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

The amount of content you can view may depend on your membership type. Please see your Membership Dashboard for details.

You agree not to access or use the Site for any unlawful purpose or in a way that may damage or impair the Site.

You must comply with all copyright and intellectual property requirements (see Section 11).

3. Privacy, Cookies and Registration

Your use of the Site is also governed by our Privacy Notice and Cookie Notice. Please read these documents to understand how we process personal data and use cookies, including affiliate- tracking cookies.

When creating a membership account you must provide accurate information and keep it up to date.

You are responsible for all use of the Site under your account. If you believe your account has been compromised, please notify us immediately at hello@afis.org.uk.

The “Remember me” feature should not be used on shared devices.

4. Membership Services

Different types of membership may allow access to different content or services. AFIS reserves the right to update or vary the content available to membership categories.

A contract for membership is formed only when we confirm activation of your membership by email following successful registration and verification.

AFIS may refuse or revoke memberships at its discretion where permitted by law.

5. Renewal and Cancellation of Personal Memberships

Personal memberships are established as lifetime memberships, unless otherwise expressly stated.

You may cancel at any time by emailing hello@afis.org.uk with the subject line “CANCELLATION OF MEMBERSHIP”, including:

  • Full name
  • Membership email address or number
  • Contact telephone number

We may suspend or terminate your membership if you breach these Terms or if events beyond our control prevent us from providing services.

6. Contracting Entity

All membership agreements and Site usage agreements are between you and:

7. User-Generated Content (UGC)

In areas where users can post content (e.g., comments or discussion forums), you are responsible for your own UGC.

You agree that you will not submit any content that:

  • infringes third-party copyrights or intellectual property
  • contains advertising or unauthorised promotions
  • is defamatory, unlawful, discriminatory or offensive
  • impersonates others
  • contains harmful software or code
  • collects or stores personal data of other users

AFIS is not responsible for the accuracy or reliability of UGC and does not endorse user views. We may remove UGC that breaches these Terms and may ban users where necessary. You retain ownership of your UGC but grant AFIS a worldwide, perpetual, non-exclusive, royalty-free licence to use, publish and reproduce it.

8. Third-Party Sites, Affiliate Links and Services

Our Site contains links to third-party websites and services (“Third-Party Sites”), including retailers, partners and affiliate networks.

When you click an affiliate link:

  • The third party may place a tracking cookie to record that AFIS referred you;
  • AFIS may receive commission if you make a purchase; and
  • AFIS does not receive your purchase details or payment information.

We are not responsible for the content, policies, products or services of Third-Party Sites. Your use of them is at your own risk.

9. Our Responsibilities to You

9.1 What we promise

We will operate the Site with reasonable skill and care and take reasonable steps to correct faults as soon as we become aware of them.

9.2 What we do not promise

The Site and all AFIS content are provided on an “as is” and “as available” basis. We do not promise that:

  • the Site will always be available, uninterrupted or error-free;
  • the content is complete, accurate or up to date; or
  • third-party services will be available.

9.3 Limitations of liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any rights you have under UK consumer law.

Subject to the above, if you are a personal member, our total liability arising from your use of the Site is limited to the membership fee paid.

We are not responsible for business losses, loss of profits, indirect or consequential losses, or events beyond our reasonable control.

10. Law and Jurisdiction

These Terms are governed by English law. The courts of England & Wales have non-exclusive jurisdiction over disputes relating to these Terms.

11. Intellectual Property

All content on the Site (text, images, logos, videos, design, etc.) is owned by AFIS or licensed to us. You may not reproduce, distribute or commercially exploit the content without permission.

12. General Terms

If any term is found invalid or unenforceable, the remainder will continue in full force.

Neither party waives rights by failing to enforce them.

You may not transfer your rights under these Terms without our consent.

13. Changes to These Terms

We may update these Terms for legal, regulatory or operational reasons. Significant changes will be noted here. If you continue to use the Site after changes are made, you are considered to have accepted the revised Terms.
